What is a Personal Injury?
Personal Injury (PI) covers any type of injury resulting from the negligence of another party, who is deemed to have breached his/her ‘duty of care’. This breach of duty, entitles the injured party to claim compensation, recur any other losses incurred and claim for other types of help and support. If an injury has been caused by another person, you will be entitled to the injuries sustained and our experienced personal injury solicitors will assist you on the case.
The time limits for making a Personal Injury Claim
In order to claim compensation for a personal injury, the time limit is three years with reference to Section 11 of the Limitation Act 1980. There are cases where the court could extend the time limit, but this would very much depend on the circumstances of the case.
The three-year limit would be considered from either of the following:
- The date of when the incident occurred that resulted in an injury
- The date of when you became apparent of the illness due to your work
- The date you became aware of the cause that resulted in a loved one’s death
The exceptions to the time limit are comprised of the following:
- A time limit is not applicable for an individual who has a deficiency in their mental capacity
- A claim can be made for a child up to the age of 21 with the injury having occurred before the age of 18
- The time limit in a foreign country could be reduced if the injury occurred abroad
- A claim would need to be made within two years if the claim has been made by way of the Criminal Injury Compensation Authority (CICA)
